Stephen Crosswell

Stephen has particular experience in competition law, monopoly infrastructure access regulation, media and telecommunications, and large scale/complex commercial litigation. Stephen is also a certified mediator and has extensive experience in alternative dispute resolution.

Prior to joining Herbert Smith, Stephen worked for a major Australian law firm where he was involved in significant media and telecommunications competition litigation. He also advised in New Zealand on complex, high value commercial/competition litigation and international arbitrations for multi-national corporations and high net worth individuals.

Stephen's experience includes advising:

  • a Hollywood film financier in dispute over significant film financing projects in New Zealand
  • a major Hong Kong telecommunications company in judicial review proceedings and proceedings before the Hong Kong Telecommunications (Competition Provisions) Appeal Board concerning public internet based VoIP and interconnection
  • a major Hong Kong telecommunications company in proceedings before the Hong Kong Telecommunications (Competition Provisions) Appeal Board concerning fixed and mobile telecommunications convergence and restructuring of regulatory policy concerning fixed-mobile interconnection
  • a multi-national telecommunications company in dispute over access to hybrid fibre/coaxial cable networks, pay and free to air television, television content rights (sports and non-sports), alleged anticompetitive behaviour in the acquisition of broadcast rights,  television and the move to digital content delivery and telecommunications infrastructure access
  • a major New Zealand telecommunications provider in dispute over inter-connect agreements
  • a multi-national telecommunications company in dispute over access to regulated telecommunications and television infrastructure and wholesale/retail broadband internet pricing
  • a multi-national petrochemical company in dispute over exploration contracts and licences
  • a global petrochemical company in dispute over access to monopoly oil and gas shipment facility
  • a global petrochemical company in up and down stream gas contract dispute and international arbitration of oil and gas reserves
