James Baily

James is a solicitor advocate and partner in the litigation and arbitration division.  He advises in relation to a wide range of commercial disputes.

James' experience includes advising in relation to construction projects in the UK and West Africa, joint-venture disputes, fraudulent misrepresentation in the context of IT contracts, claims under gas supply agreements and disputes as to the jurisdiction of the English courts.  In 2001 he was seconded to work for a major international oil company in London for nine months.

  • Chevron Nigeria Limited in the case of International Finance Corporation v. DSNL Offshore Limited and Others, relating to the disputed seizure of water-injection modules for a Nigerian project.
  • British Sky Broadcasting on claims arising out of a the installation of a new customer relationship management system.
  • IBM in its claims against Thorn UK Limited under a contract for the provision of IT services to a network of retail outlets including the "Radio Rentals" chain.
  • BHP Billiton v. Dalmine SpA in relation to claims arising out of the sale of a defective gas re-injection pipeline forming part of the Liverpool Bay Development.
  • Eni against the joint administrators of a major industrial gas customer concerning the price to be paid for deliveries of gas under a UK gas sales agreement.
  • A dispute before the Court of Appeal and House of Lords by Greek and Lebanese defendants as to the jurisdiction of the English courts.
  • A major international oil company on potential claims under force majeure provisions arising as a result of political and social unrest in the Niger delta.
  • A confidential arbitration involving claims relating to delays in the construction of a gas pipeline in West Africa.
