Maurice Burke

Based in Singapore, Maurice is joint head of Herbert Smith’s dispute resolution practice in Southeast Asia and responsible for covering the Singapore, Malaysian and Indonesian markets. Originally qualified in Australia, Maurice qualified in Hong Kong in 1996, where he worked as a litigator for two years before joining Herbert Smith's Hong Kong litigation division in 1997. Since joining Herbert Smith, Maurice has conducted a broad range of commercial litigation and dispute resolution matters throughout Asia.

  • Halliburton in a successful defence of Indonesian claims arising out of the construction of a petroleum facility
  • Newmont in relation to Indonesian disputes (arbitration, litigation) including proceedings brought by the Government of Indonesia alleging violation of Indonesian environmental laws
  • a major Malaysian oil and gas corporation in a dispute (concerning geotechnical and performance issues) with a US drilling contractor on an oil exploration project in South East Asia
  • CSFB, Merrill Lynch and other investment banks in the defence of Indonesian law proceedings before the Jakarta District Court by PT Tripolyta, an Indonesian petrochemical conglomerate, concerning a US$185m bond issue
  • Mitsubishi Corporation regarding Indonesian and Chinese trade finance claims 
  • a German bank in relation to a US$75 million-plus Singapore fraud case, including advising as to strategy and co-ordination of asset tracing and recovery proceedings in Singapore, Australia, the PRC and elsewhere
  • a Singapore telecommunications operator regarding investment-related issues and treaty rights
