Mining

It is our combination of civil and common law skills and our understanding of the culture, language and legal systems of the major mining countries in which we work, that makes our mining team so strong. The practice is built in part on our strong energy and natural resources practice and in part on our long-established Africa practice, based in the Paris office.

Our mining specialists work hand in hand with experts from other parts of the practice as and when appropriate. This means we combine lawyers with in-depth sector and regional knowledge, with the breadth of all the practice areas in which we field specialist advisers.

Our main practice areas are:

  • projects: we can build a project from scratch, taking into account bankability, customs and excise and tax as well as legal issues
  • M&A: we can advise on major transactions wherever they arise
  • arbitration: the combination of mining experience and the firm’s strength in international arbitrations makes us the perfect choice for companies and states in mining arbitrations
  • finance: our expertise in both civil and common law helps us to advise both banks and corporates on financing issues

We act for companies active in the mining of coal and coke, gold, iron, minerals, nickel and tin. Also for investment banks and finance vehicles and for national governments. Major clients include: Republic of Senegal, Lonmin, Mitsui, Kumba Resources, BHP Billiton and Rothschilds.

This is an international practice with particular strength in UK, Eastern Europe, Asia and Africa. Our association with Hiswara Bunjamin & Tandjung in Indonesia augments the service we can offer to our mining clients. They offer advice to local companies and foreign investors on establishment, financing, operations and corporate matters.
